📋 Agreement to These Terms

These Terms of Use form a legally binding agreement between you and Nocturnal Devs regarding your use of the Calorie Log mobile application and related website materials.

📱 What Calorie Log Does

Calorie Log is a personal wellness and food tracking app. Features may include meal logging, photo analysis, typed AI analysis, barcode lookups, saved favorites, local backups, optional ads, and an optional paid subscription tier.

⚠️ Not Medical Advice

Nutrition estimates, barcode data, AI-generated results, and other recommendations may be incomplete or inaccurate. You are responsible for reviewing results and making your own health and dietary decisions.

✅ Eligibility and Acceptable Use

By using Calorie Log, you agree that you will:

• Use the app only for lawful purposes
• Use the app for personal, non-commercial use unless we agree otherwise in writing
• Provide information and content you have the right to use and share
• Not interfere with, damage, reverse engineer, or misuse the app or related services
• Take responsibility for maintaining the security of your own device and backups

💳 Subscriptions, Free Tier, and Ads

Calorie Log may offer both a free tier and a paid tier.

• The free tier may include advertising and daily usage limits for some features.
• The paid tier is currently described in-app as an auto-renewing monthly subscription priced at $4.99 USD/month, providing 30 AI scans per day, unlimited barcode scans, and no ads.
• Subscription billing, renewals, cancellations, refunds, and account management are handled by Apple through your Apple account and device subscription settings.
• If you cancel, access to paid features generally continues until the end of the current billing period.
• Rewarded ads may sometimes grant temporary bonus credits when ad inventory is available.

🌐 Third-Party Features

Some app functionality depends on third-party services, including AI processing endpoints, Open Food Facts barcode lookups, optional location-derived country hints, Firebase Analytics, ad providers, and Apple in-app purchases.

Your use of those features may also be subject to the terms and privacy policies of the relevant third-party provider.

📤 Local Data, Exports, and Device Responsibility

Calorie Log is designed to keep most user data on-device. You are responsible for:

• Maintaining access to your own device and backups
• Choosing when to export or share your data
• Reviewing imported files before using them
• Complying with any local laws that apply to exported or shared data

💡 Intellectual Property

All rights in Calorie Log, including the app, website content, design, software, branding, and documentation, belong to Nocturnal Devs or its licensors.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal use in accordance with these Terms.

🚫 Disclaimers and Limitation of Liability

Calorie Log is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the maximum extent permitted by law, Nocturnal Devs is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from your reliance on estimates, service interruptions, third-party services, local data loss, or device issues.

⚖️ Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

📝 Changes to These Terms

We may update these Terms from time to time. If we do, the updated version will be posted here with a revised "Last Updated" date.
